Santhoshi's  Kitchen

I, the undersigned, hereby acknowledge and agree that I am voluntarily participating in a cooking class (the “Class”) taught by Santhoshi’s Kitchen LLC (“Santhoshi’s Kitchen”). I acknowledge and agree to comply with all instructions, both written and stated, during my participation in the Class. I acknowledge such participation requires the use of open flames, sharp knives, hot pans, spices, and other hazards that cannot be eliminated without jeopardizing the quality of the activity. I acknowledge that such participation includes, but is not limited to, the risk of (i) injury from the activity and/or equipment utilized; (ii) possible equipment failure, malfunction, and/or misuse by myself or others; (iii) the negligent handling of the equipment and/or negligence of others in the class; (iv) damage to my personal property; and (v) food-borne injury, illness, or death.

I, for myself and on behalf of my successors and assigns, hereby:

1. Waive and release Santhoshi’s Kitchen and its agents, including Santhoshi Radhakrishnan and Suresh Sundarababu, from any and all claims, attorneys fees, demands, liabilities, damages, losses, expenses, and obligations of every type or character, known or unknown, absolute or contingent, direct or consequential, whether it arising at law or in equity, pursuant to contract, tort, statute or otherwise, which I not have or may have in the future arising out of or in any manner connected with the Class. 

2. Agree and acknowledge that I accept and assume all foreseeable and unforeseeable risks of injury, including but not limited to the stated above risks, while participating and in connection with participating in the Class. I further agree to immediately cease all participation in the class in the event I sustain an injury and immediately make Santhoshi’s Kitchen aware of any injuries. I acknowledge I am free to withdraw from participation in the Class at any time. Santhoshi’s Kitchen has no duty to warn me of any specific risks, dangers, or hazards. 

3. Release and hold harmless Santhoshi’s Kitchen and its agents, including Santhoshi Radhakrishnan and Suresh Sundarababu, from all injury, disability, death, loss, or damage to myself or my property whether by negligence, recklessness, or otherwise.  

4. Will indemnify Santhoshi’s Kitchen, including Santhoshi Radhakrishnan and Suresh Sundarababu, for any claim, actions, demands, injury, disability, loss, or damage arising out of my participation in the Class, whether by negligence, recklessness, or otherwise.

5. Consent for all purposes, to allow for the reproduction and use of any photographs, videos, derivative works, and/or likeness in any form and all manners of me, with or without the use of my name, by Santhoshi’s Kitchen and in connection with any media, promotional materials, brochures, websites or other advertising material. In giving this consent, I release Santhoshi’s Kitchen from liability for any violation of any personal and/or proprietary right I may have in connection therewith. I hereby waive any right to compensation from such use of the foregoing. 

6. This assumption of risk, waiver and release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be invalid or unenforceable, all the remaining terms shall be enforceable. 

I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK, WAIVER, AND RELEASE AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMTENTS, OR INDUCEMENT APART FROM THE FOREGOING AGREEMENT HAVE BEEN MADE TO ME. I REPRESENT I AM AT LEAST 18 YEARS OF AGE AND LEGALLY COMPETENT TO EXECUTE THIS AGREEMENT.
